1. Introduction

These Terms & Conditions (“Terms”) govern your access to and use of the SafalVisa website, mobile services, any type of application and payment platform.

By registering as a User or Institution, you confirm that you have read, understood, and agreed to be bound by these Terms.

If you do not agree, you must stop using our platform immediately.

2. Definitions

Platform

SafalVisa’s website, applications, and payment services.

User

Any individual seeking study, work, training, language, or visa-related services through SafalVisa.

Institution

A licensed consultancy, training centre, manpower agency, or service provider listing services on SafalVisa.

Listing

A published service offering such as study visa, work visa, manpower, test preparation, training, course change, tourist visa, family immigration, or flight ticket assistance.

Booking

A scheduled consultation or service appointment between a User and an Institution arranged through the Platform.

Payment Request

A request initiated by an Institution through the Platform for a User to make payment for agreed services.

Service Charge

A platform usage fee charged by SafalVisa to Institutions for each transaction processed through the platform. The specific rate is communicated to Institutions separately through partnership agreements and is not publicly disclosed.

Success Fee

An additional fee that may apply to Institutions when specific service outcomes are achieved (such as visa approval and student departure abroad). The Success Fee structure, criteria, and amounts are communicated to Institutions privately and are not publicly disclosed.

Payment Processing Fee

A fee charged by third-party payment gateway providers (eSewa, Khalti, banks) for processing online transactions.

3. Role of SafalVisa

SafalVisa is an intermediary marketplace that connects Users with verified Institutions.

What SafalVisa Does Not Provide

We do not directly provide visa consultancy services, test preparation, recruitment services, immigration legal advice, or university admissions processing.

What SafalVisa Does Provide

SafalVisa’s role is limited to providing the digital platform for discovery and booking, facilitating online payment processing (when applicable), tracking and reporting transactions, providing customer support, and mediating disputes between Users and Institutions.

No Guarantee of Outcomes

SafalVisa does not guarantee any visa approval, university admission, job placement, test score, processing timeline, or any other outcome. Final decisions rest solely with embassies, consulates, government immigration authorities, universities, educational institutions, and the Institutions providing services. SafalVisa’s role is limited to connecting Users with qualified Institutions. We cannot influence or control immigration decisions, institutional policies, or government regulations.

4. Platform Purpose

SafalVisa’s mission is to make international education opportunities, work visa programmes, manpower services, language preparation, and study abroad services more accessible and trustworthy for Users in Nepal by partnering with verified, licensed Institutions.

We aim to provide transparency, security, and convenience in the consultancy booking and payment process.

5. Eligibility & Age Requirements

5.1 Age Confirmation (Two Checkpoints)

SafalVisa requires age confirmation at two points:

At Registration

During account registration, all Users must check a mandatory checkbox confirming: “I am 18 years or older, or I have the consent of a legal guardian to use these services.” This is a general declaration required alongside the Privacy Policy and Terms & Conditions checkboxes. By checking this box, you represent and warrant that you meet this requirement.

At Booking

When booking a consultation with an Institution, all Users must check a mandatory checkbox confirming: “I confirm that I meet the age requirements for this service.” This is a service-specific confirmation because different services have different age requirements (for example, work visa requires 18+ while study visa allows 16+ with parental consent).

Providing false information at either checkpoint is a violation of these Terms and may result in account termination.

5.2 Age Requirements by Service Type

Work Visa, Tourist Visa & Family Immigration Services

These services are strictly for Users aged 18 and older. Institutions must not provide these services to anyone under 18, regardless of parental consent. Institutions are responsible for verifying the User’s age during the mandatory free consultation before proceeding with any paid services.

Study Visa, Training, Test Preparation & Course Change Services

These services are available to Users aged 16 and older with the consent of a parent or legal guardian. Minors aged 16–17 should attend the mandatory free consultation accompanied by their parent or legal guardian. The Institution is responsible for verifying parental consent in person before sending a payment request.

Users Under 16

SafalVisa services are not intended for individuals under 16. Users under 16 should not create accounts.

5.3 How Age Verification Works

SafalVisa operates as a marketplace with a mandatory free consultation requirement. This means every User meets the Institution face-to-face before any payment is made. Age verification works through three layers: first, the registration checkbox (general age declaration); second, the booking checkbox (service-specific age confirmation); and third, the mandatory free consultation where the Institution verifies the User’s age and eligibility in person. For minors aged 16–17, the Institution verifies that a parent or guardian is present and consents to the services. No payment can be made until the Institution sends a payment request — the User cannot pay independently. This multi-layered approach provides practical age verification without requiring personal identity documents to be submitted to the platform.

5.4 Institution Responsibility for Age Verification

Institutions are responsible for verifying age and eligibility during the mandatory free consultation. Institutions must not send payment requests for work visa, tourist visa, or family immigration services to anyone they know or reasonably believe to be under 18. For study visa, training, test preparation, and course change services, Institutions must verify that a parent or guardian consents before sending a payment request to a User aged 16–17. If an Institution knowingly provides age-restricted services to an underage User, the Institution bears full responsibility and SafalVisa shall not be liable.

5.5 User Responsibility

By using SafalVisa, you confirm that the information you provided during registration and booking (including both age confirmation checkboxes) is truthful and accurate. You are responsible for meeting the age requirements for the services you book. Providing false age information at either checkpoint is fraud and may result in account termination and legal action.

6. User Rights & Responsibilities

6.1 User Rights

Free Initial Consultation

All consultations booked through SafalVisa must include a FREE initial consultation with the Institution. Institutions may only request payment AFTER the consultation is provided and services are clearly explained. If any Institution demands payment before providing the free consultation, report immediately to contact@safalvisa.com.

Transparent Pricing

Users are entitled to view complete fee breakdowns before making any payment decisions.

Secure Payments

Users may choose between online payment (eSewa, Khalti, bank transfer) or cash payment (directly to Institution), both facilitated through the SafalVisa platform.

Customer Support

Users have access to SafalVisa’s support team for assistance, questions, or dispute resolution.

WhatsApp Notifications

Users will receive important updates, official bills, and transaction confirmations via WhatsApp.

6.2 User Responsibilities

Provide Accurate Information

Users agree to submit complete, truthful, and accurate personal information during registration and service applications, including the age confirmation checkboxes at registration and booking.

Active WhatsApp Number

Users must provide a real and active WhatsApp number to receive official SafalVisa notifications, bills, and important updates. SafalVisa is not responsible for missed communications if the provided number is incorrect or inactive.

Use Official Payment Channels

For online payments and cash payments, Users must use only SafalVisa’s official payment channels. For cash payments, Users must obtain official receipts from Institutions. Users must refrain from making any direct payment to Institutions outside SafalVisa’s official payment channels for services booked through the platform.

Review Listings Carefully

Users must read each Listing’s requirements, eligibility criteria, and ask fee structure before making payment decisions.

Report Issues

Users must report any suspicious activity, fraud, or concerns via the in-platform Report tool or by emailing contact@safalvisa.com.

System-Generated Bills Notice

SafalVisa is not responsible for any dispute or confusion caused by unsigned system-generated bills. Only official SafalVisa bills that are signed and dated are legally valid. Always verify that your bill is officially signed and dated before considering it valid.

7. Institution Rights & Responsibilities

7.1 Institution Rights

Access to Verified Users

Institutions receive booking enquiries from Users who have registered on SafalVisa.

Dashboard Access

Institutions can track bookings, payments, earnings, and performance metrics through the Institution Dashboard.

Payment Processing

Institutions receive payments (minus applicable service charges) for services booked through SafalVisa.

Marketing Support

Institutions benefit from SafalVisa’s marketing efforts to attract Users to the platform.

7.2 Institution Responsibilities

Provide Accurate Information

Institutions must submit honest and verifiable information about their company, licenses (PAN registration, business permits, consultancy registration certificates), and service details.

Free Initial Consultations

Institutions must provide FREE initial consultations to all Users who book through SafalVisa. Payment may only be requested AFTER the consultation is provided and services are explained. This is mandatory for all Institutions.

Verify Age and Eligibility

Institutions must verify the User’s age and eligibility during the mandatory free consultation. Institutions must not provide work visa, tourist visa, or family immigration services to Users under 18. For Users aged 16–17 seeking study visa, training, test preparation, or course change services, the Institution must verify that a parent or guardian is present and consents before sending a payment request.

Transparent Pricing

Institutions must display clear, complete pricing information including destination country, visa type, eligibility requirements, and total fees.

Honour Platform Rules

Institutions must not engage in over-charging, side-payments, or bypassing the platform. All transactions for services booked through SafalVisa must follow platform procedures.

Accept Dual Payment Options

Institutions must accept both online payments (processed through SafalVisa) and cash payments (collected directly at their office) as chosen by the User.

Report Cash Payments

When receiving cash payments from Users, Institutions must report the transaction to SafalVisa within 24 hours through the Institution Dashboard.

Deliver Promised Services

Institutions must provide services exactly as described in Listings and comply with all Nepali laws and immigration regulations.

Active WhatsApp Number

Institutions must provide a real and active WhatsApp number to receive official SafalVisa notifications, payment confirmations, and important updates.

Professional Conduct

Institutions must maintain professional standards and ethical practices at all times and must not engage in activities that harm SafalVisa’s reputation.

7.3 Cash Payment Reporting Requirements

When an Institution receives cash payment directly from a User for services booked through SafalVisa, the following applies:

Report Within 24 Hours

The Institution must log the payment in their SafalVisa Dashboard within 24 hours of receipt.

Await Invoice

SafalVisa will issue a service charge invoice within 2 business days.

Pay Service Charge

The service charge must be paid within 7 days of the invoice date.

Verification

SafalVisa may verify cash payments with Users to ensure accurate reporting.

Non-Compliance Consequences

Failure to report cash payments may result in account suspension, audit of transaction history, termination of partnership, or legal action for breach of agreement.

8. Payments & Fees

8.1 Dual Payment Options

Users may pay Institutions through two methods:

Online Payment

Payment is processed via SafalVisa’s secure payment gateway using eSewa or Khalti. Payment is processed instantly through the platform. The service charge is automatically deducted by SafalVisa. The Institution receives the net amount in their SafalVisa wallet. Funds can be withdrawn to the Institution’s bank account after service begins.

Cash Payment

Payment is made directly to the Institution at their office. The User visits the Institution’s office. The Institution creates a payment request via SafalVisa. The User confirms their payment method as “cash” in the SafalVisa system. The User pays cash to the Institution and the Institution provides a receipt. The Institution reports the payment to SafalVisa within 24 hours. SafalVisa invoices the Institution for the applicable service charge. The Institution pays the service charge separately within 7 days.

Users are free to choose either payment method based on their preference.

8.2 Service Charges & Fees

Service Charge (For Institutions)

SafalVisa charges Institutions a Service Charge for each transaction processed through the platform. This charge covers platform technology and maintenance, user acquisition and marketing, customer support services, payment processing infrastructure, and transaction tracking and reporting. The specific rate and calculation method of the Service Charge is communicated to Institutions separately through their partnership agreements and is not publicly disclosed.

Success Fees (For Institutions)

In certain cases, when specific service outcomes are successfully achieved (such as visa approval and student departure abroad), SafalVisa may charge Institutions an additional Success Fee as defined in separate agreements. The Success Fee structure, criteria, and amounts are communicated to Institutions privately and are not publicly disclosed.

Payment Processing Fees

Payment gateway processing fees (charged by eSewa, Khalti, or banks for online transactions) are covered within SafalVisa’s service charge. Users are not charged any additional gateway fees on top of the amount shown in their payment request. The total amount displayed is the total amount paid.

8.3 Fee Modifications

SafalVisa reserves the right to modify Service Charges, Success Fees, and fee structures with sixty (60) days advance notice to Institutions. Fee changes will be communicated via email notification, Institution Dashboard announcement, and WhatsApp notification. Continued use of the platform after fee changes constitutes acceptance of the new fee structure.

8.4 WhatsApp Notifications

By using SafalVisa and providing your WhatsApp number during registration, you consent to receiving important updates, official bills, payment requests, transaction confirmations, booking notifications, and service-related communications via WhatsApp. WhatsApp notifications are provided for your convenience alongside email and dashboard notifications. You may opt out of non-essential WhatsApp messages by contacting us at contact@safalvisa.com, but transactional notifications (payment confirmations, booking updates, payment requests) cannot be opted out of while your account is active.

8.5 System-Generated Bills & Official Documents

Payment confirmations, receipts, and transaction summaries generated automatically by the SafalVisa platform are system-generated records provided for informational and reference purposes. These documents are not official bills or invoices unless they bear an authorised signature and date from Safal Visa Pvt. Ltd. SafalVisa is not responsible for any dispute, confusion, or claim arising from the use of unsigned or undated system-generated documents. Always verify that any bill or invoice you rely upon is officially signed and dated before considering it valid.

8.6 Receipts & Official Bills

Automated System Receipts

System-generated receipts are issued automatically for online payments. These are for immediate reference only and are not legally valid as official bills.

Official SafalVisa Bills

Official bills will be signed and dated by SafalVisa and delivered via WhatsApp or email. Only these signed and dated bills are legally valid. They should be used for accounting, tax, and legal purposes.

Always request and verify official signed bills for your records.

9. Refund & Cancellation

9.1 Refunds Will Be Considered In

User Refunds

Refunds will be considered for duplicate or accidental payments, service cancellation by SafalVisa or Institution before services begin, verified technical or payment processing errors, and Institution failure to provide promised services. Processing time is 7–14 business days to the original payment method.

9.2 Refunds Will Not Be Provided For

From SafalVisa

SafalVisa will not refund service charges for transactions where services were initiated, or cancellations after the Institution has begun processing (documentation, applications, etc.).

From Institutions (Separate Policies)

Institutions are not required to refund for visa rejection by embassies, consulates, or government authorities; delays caused by incorrect or incomplete User information; voluntary User withdrawal after services have begun; or external delays beyond Institution or SafalVisa control. Each Institution sets their own refund policy.

9.3 Institution Refund Responsibility

Visa Rejections

Institutions are responsible for refunding User service fees according to their own refund policies. Users should ask about the Institution’s visa rejection refund policy during the free consultation. SafalVisa’s service charges may be non-refundable.

Service Quality Issues

If an Institution fails to deliver promised services, SafalVisa may facilitate refunds from the Institution to the User.

9.4 Refund Process

To request a refund, email contact@safalvisa.com with your Booking ID, transaction details, reason for refund request, and supporting documentation. SafalVisa will review within 3–5 business days. Approved refunds are processed within 7–14 business days to the original payment method. Bank charges, currency conversion costs, and transfer delays are the User’s responsibility.

10. Platform Attribution & Branding

10.1 Success Stories & Testimonials

Institutions and Users acknowledge that SafalVisa facilitates connections and services on the platform. When sharing success stories, testimonials, case studies, or promotional content related to services completed via SafalVisa, appropriate credit to SafalVisa as the facilitating platform is appreciated. This is voluntary cooperation and helps build trust in the marketplace.

10.2 Marketing Materials

SafalVisa may feature Institutions and their success stories in platform marketing materials, social media posts, blog articles, and promotional campaigns. Institutions consent to reasonable use of their business name, logo, and success stories for SafalVisa marketing purposes. Sensitive User information will be anonymised or used only with explicit User consent.

11. Limitation of Liability

11.1 SafalVisa Shall Not Be Held Liable For

SafalVisa is not liable for visa rejections or policy changes by foreign governments; service failures, errors, or negligence by Institutions; fraudulent practices by Institutions outside platform rules; financial losses caused by inaccurate User information; delays in visa processing by embassies or institutions; changes in immigration laws or policies; technical failures of third-party payment gateways; lost documents, missed deadlines, or administrative errors by Institutions; User disputes with Institutions regarding service quality; or Institutions providing age-restricted services to underage Users after failing to verify age during the free consultation.

11.2 Maximum Liability

SafalVisa’s maximum liability for any claim related to platform use is limited to the Service Charge retained by SafalVisa for the specific disputed transaction. In no event shall SafalVisa be liable for indirect, consequential, or punitive damages; lost profits, business opportunities, or revenue; reputational harm; or emotional distress.

11.3 Institution Indemnification

Institutions agree to indemnify and hold SafalVisa harmless from any claims, damages, or expenses arising from the Institution’s breach of these Terms, the Institution’s negligence or misconduct, the Institution’s violation of laws or regulations, claims by Users regarding Institution services, fraudulent or unethical practices by the Institution, or the Institution’s failure to verify User age and eligibility before providing services.

12. Privacy & Data Protection

12.1 Data Collection & Use

We collect and use personal data only as necessary to provide platform services, facilitate bookings and payments, connect Users with Institutions, provide customer support, improve platform functionality, and send important notifications via WhatsApp.

12.2 Data Sharing

Personal data is shared only with the specific Institution involved in a User’s booking, payment gateway providers (for transaction processing), and legal authorities (when required by Nepal law). We do not sell, rent, or share User data for marketing purposes without explicit consent.

12.3 Data Security

SafalVisa uses industry-standard security technologies to encrypt sensitive data, protect against unauthorised access, secure payment transactions, and back up data regularly. We comply with Nepali data protection standards and best practices.

12.4 WhatsApp Communications

By providing your WhatsApp number during registration, you consent to receiving important notifications, official bills and receipts, customer support messages, and booking and payment updates. You may opt out of promotional messages at any time, but transactional notifications cannot be opted out of while your account is active.

13. Intellectual Property

13.1 SafalVisa Property

All content on the SafalVisa platform is protected by copyright and remains the exclusive property of SafalVisa, including logos, branding, trademarks, website design and layout, software and code, text, images, media, and platform functionality. Unauthorised reproduction, modification, or redistribution is strictly prohibited.

13.2 Institution Content

Institutions retain ownership of their own content (business descriptions, photos, service details) but grant SafalVisa a limited, non-exclusive licence to display content on the platform, use content in marketing materials, and create derivative summaries or excerpts. This licence terminates when the Institution removes content or terminates their partnership.

13.3 User Content

Users retain ownership of personal information and documents submitted but grant SafalVisa permission to store and process information for service delivery, share relevant information with Institutions, and use anonymised data for platform improvements.

14. Suspension & Termination

14.1 Grounds for Suspension or Termination

SafalVisa reserves the right to immediately suspend or permanently terminate any User or Institution account found engaging in fraudulent activities (fake documents, false information, payment fraud, identity theft, providing false age confirmation); violating these Terms (bypassing platform payment rules, making or accepting side payments, not reporting cash transactions, not providing free initial consultations); or engaging in unethical or illegal practices (misleading advertising, harassment, violation of Nepal laws, repeated poor service or negative reviews, providing age-restricted services to underage Users).

14.2 Effects of Suspension

During suspension, account access is restricted, no new bookings are accepted, pending transactions may be frozen, and the Institution must resolve issues before reactivation.

14.3 Effects of Termination

Upon permanent termination, account access is permanently revoked, the Listing is removed from the platform, outstanding payments must still be settled, and User or Institution data may be retained for legal purposes. SafalVisa may terminate without prior notice in cases of serious violations. In other cases, 7-day notice may be provided.

15. Governing Law & Dispute Resolution

15.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Nepal.

15.2 Jurisdiction

All disputes arising from these Terms or platform use shall fall under the exclusive jurisdiction of the competent courts of Kathmandu, Nepal.

15.3 Dispute Resolution Process

In case of disputes between Users, Institutions, or SafalVisa, the following process applies. Step 1: Contact SafalVisa customer support for mediation (3–5 business days response). Step 2: Parties attempt good faith negotiation to resolve the dispute (15 days). Step 3: Neutral third-party mediation (optional, costs shared). Step 4: Legal action may be filed in Nepal courts (Kathmandu jurisdiction).

15.4 Consumer Protection

Nothing in these Terms limits your rights under the Nepal Consumer Protection Act 2075 or any other applicable consumer protection legislation.

16. General Provisions

16.1 Independent Contractors

Users, Institutions, and SafalVisa are independent parties. Nothing in these Terms creates an employment relationship, partnership, joint venture, agency relationship, or fiduciary duty.

16.2 Entire Agreement

These Terms, together with our Privacy Policy, Refund & Cancellation Policy, and any applicable Partnership Agreement, constitute the entire agreement between you and SafalVisa regarding platform use, superseding all prior agreements, discussions, or understandings.

16.3 Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

16.4 Waiver

Failure by SafalVisa to enforce any provision does not constitute a waiver of that provision or any other provision.

16.5 Force Majeure

SafalVisa shall not be liable for failure to perform obligations due to events beyond reasonable control, including acts of God (earthquakes, floods, natural disasters), war, terrorism, civil unrest, pandemics or health emergencies, government actions or restrictions, internet or telecommunications failures, or power outages or technical failures.

16.6 Language

These Terms are written in English. In case of translation conflicts, the English version prevails.

16.7 Record Retention

SafalVisa maintains payment and transaction records for a minimum of 7 years in accordance with Nepal tax law requirements.

17. Amendments to Terms

17.1 Right to Modify

SafalVisa reserves the right to update, modify, or amend these Terms at any time.

17.2 Notice of Changes

Material changes will be communicated through one or more of the following methods: email notification to registered users, Dashboard announcement, WhatsApp notification, or website banner notification. SafalVisa will select appropriate communication method(s) based on the nature and urgency of changes. For major changes affecting fees or user rights, multiple methods will be used.

17.3 Effective Date

Changes become effective immediately upon posting for minor updates, 30 days after notification for major changes, and 60 days after notification for fee structure changes.

17.4 Acceptance of Changes

Continued use of the platform after changes constitutes acceptance of the updated Terms. If you do not agree to changes, you must stop using the platform and may close your account.

18. Acknowledgement & Acceptance

By creating an account, booking services, or using the SafalVisa platform in any way, you acknowledge that you have read these Terms & Conditions in full, you understand your rights and responsibilities, you agree to be legally bound by these Terms, you have confirmed via the registration checkbox that you are 18 or older or have the consent of a legal guardian, you have confirmed via the booking checkbox that you meet the age requirements for the specific service booked, you consent to SafalVisa’s Privacy Policy, you will comply with all platform rules and procedures, and you accept the limitations of liability stated herein.

If you do not agree to these Terms, you must immediately stop using SafalVisa.

19. Special Notices

19.1 Official Bills Reminder

System-generated receipts are NOT official bills. Only signed and dated bills from SafalVisa are legally valid. Always verify signatures before accepting any bill as official.

19.2 Free Consultation Guarantee

All initial consultations booked through SafalVisa MUST be FREE. If any Institution demands payment before providing consultation, report immediately to contact@safalvisa.com.

19.3 Cash Payment Reporting

All cash payments received from Users must be reported by Institutions within 24 hours. Failure to report may result in account suspension.

19.4 WhatsApp Verification

Provide a real and active WhatsApp number to receive official notifications. SafalVisa does not send bills or important information via unverified channels.

19.5 Age Verification Responsibility

SafalVisa relies on two checkboxes (at registration and at booking) and the mandatory free consultation for age verification. Institutions are responsible for verifying User age and eligibility in person before sending payment requests. SafalVisa is not liable for Institutions providing age-restricted services to underage Users.
